Do you think I can complain on the grounds of copyright since they've not requested permission to use the image ?

It's been taken from the Owners Club website. Grrr.

Our company got scammed by Getty Images to the tune of £1500 for a tiny picture of theirs that was on our web-site without permission (courtesy of a third-party web-designer who claimed not to have given it to us). So there is plenty of money in copyrighted images.

Just send an nasty legal letter asking for extortionate sums - after several rounds of lawyers letters - you'll may end up with something.

You know our company had the same problem from Getty images, they wanted £6k luckily we had proof that the design house had supplied them.

Get your dues Chris

On a more serious point this should be done by the club for club funds (the fridge magnet that is), the guy on ebay is doing it for his own reward and has used your photo without your permission.

I agree. Copyright usually belongs to the person taking the photo. There may be some terms & conditions governing the website where it was published (e.g. stating that it was not to be copied). If the photo was copied from the web then the copyright owner would be justified in sending a legal letter to get them to stop. Cheers, David

It's fairly clear-cut. The photo was taken by me, and it was published on the club website.

According to the perpetrator it was a "genuine mistake".

Hmmm.

Sadly, as it was published on our website the perpetrator must also be a member of our club.
I hope he or she is reading this and learning from their mistake.

Well, not quite true. The picture was Car of the Month Nov 97, so was / is visible to the general public.
